Terms of Use and Service

Article 1 - Object

The present general conditions of sale govern the sales by the company Just_Elo of personalized illustrations and original designs marketed on the site

The company Just_Elo reserves the right to modify the present general conditions of sale. Any new version will be indicated in the “T.O.S. & T.O.U.” section.

Article 2 - Price

In accordance with article n°293B of the French General Tax Code, VAT is not applicable to our services.All prices are quoted in euros, exclusive of VAT.All orders, whatever their origin, are payable in euros. Just_Elo reserves the right to modify its prices at any time, but the service will be invoiced on the basis of the rate in force at the time the order is validated.

Article 3 - Order

You can place your order directly by message on one of my networks or by e-mail. The contractual information is presented in French and will be confirmed at the latest when your order is validated [Order summary invoice including a short description/the price of your order].To ensure the best possible processing of your order, you will be asked to provide one or more recent and/or current reference images of your character.

The company Just_Elo reserves the right not to accept a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of non-compliance with the TOS, or in the event of difficulty concerning the order received.

3.1 InvoiceIn order to issue the invoice, you will be asked to provide information such as your name, username and/or email address. This information must be accurate and allow us to send the invoice directly to your Paypal account.This information will only be collected and used to process your order.

Article 4 - Order Validation

By proceeding with the validation and payment of the order, you declare to accept fully and without reserve the entirety of the present general conditions of sale. In the event of non-compliance with these conditions, Just_Elo reserves the right to refuse or cancel your order. The work already done will be sent to you and the refund will only be equivalent to the value of the work not carried out.For each order, you will systematically receive an invoice summarizing your order. This invoice is proof of the transaction.

Article 5 - Payment

Payment for your order is made in euros and with Paypal only. By validating the invoice sent to you, you agree to pay the price indicated. You guarantee that you are fully authorized to use this means of payment, and that it gives access to sufficient funds to cover all costs resulting from your order. The order can only be started or continued after full payment of the price corresponding to the invoice sent. Payment plans can be discussed, in which you will be asked to make an initial payment of at least 50% of the total price. Illustrations remain the property of Just_Elo until full payment has been received.
Prices are non-negotiable and we are not responsible for any problems arising during the transaction.5.1 Requests for additions after initial paymentIn the event of a request for an addition to your order, affecting the price of the latter, being made after the initial payment, and this regardless of the stage in the production process, an additional payment equivalent to the value of the addition will be requested, failing which none of the said additions will be made.5.2 Requests for modifications after initial paymentIn the event of a modification request, impacting the rendering of your order, being made after the sketch has been validated, an additional payment equivalent to the value of the modification will be requested, failing which none of the said modifications will be carried out.

Article 6 - Retraction

You have a withdrawal period of 7 days from receipt of the design/character purchased to exercise your right of withdrawal without having to justify your reasons or pay any penalty.6.1 Declaration of withdrawalPrior to any request for withdrawal, you must notify us of your intention to withdraw by sending us an unambiguous declaration, by e-mail only, to the following address: [email protected].
As soon as we receive your declaration of withdrawal, an email acknowledging receipt of your declaration of withdrawal will be sent to you within 5 days of your request for withdrawal.6.2 RefundsOnce your retraction request has been received and validated, you will be asked to make a claim directly via Paypal. Otherwise, no refund will be made from the account of the company Just_Elo.
Refunds will be made within the time allowed by Paypal in the event of a dispute.
If the company cancels the order, the refund will be made directly to the company's paypal account.6.3 Exceptions to the right of retractionIn application of the provisions of article L121-21-8 of the French Consumer Code, products that are made to your specifications and/or clearly personalized do not benefit from the right of withdrawal, once the service has begun.

Article 7 - Availability

The number of places available for ordering are shown on the home page of https://justelowebsiteeng.carrd.co and are limited to 3 at a time.
If no place is available, you can reserve one by requesting that your name be added to the waiting list. As soon as a place becomes available, a message will be sent to you. You will have 3 days to confirm your order and access the available space.

Article 8 - Deadlines

The lead times for customized projects are not predefined and will depend on the quantity and complexity of the project.
Approximate lead times will be provided on the invoice, but please bear in mind that these are not definitive and will depend on various factors.Although there are no fixed deadlines, you can ask for a certain deadline to be respected.
In the case of a request for priority delivery or a deadline of less than 2 weeks from the date of payment, a surcharge will be applied at the time of payment, depending on your order, and will be mentioned on the invoice.In the event of an obligation that prevents us from meeting the requested deadline, a message will be sent to inform you of this.
In the event of total inability to complete your order, a refund equal to the sum of the steps not taken will be made by Paypal within 14 working days of the message informing you of this.Your order will be processed from Monday to Saturday, except on french public holidays.
Any harassment during the order creation process is strictly forbidden. Otherwise, Just_Elo reserves the right to refuse or cancel your order. The work already carried out will be sent to you and the refund will only be equivalent to the value of the work not carried out.

Article 9 - Guarentee

Images of the progress of your order will be sent to you throughout the creation process, allowing you to request modifications throughout the process. For this reason, once your order has been completed, you will not be entitled to a refund or price reduction in accordance with article 6.3.
In the event of an error during the creation process, you will not be charged for the necessary modifications.

Article 10 - Responsability

The services offered comply with current French legislation. Just_Elo cannot be held responsible in the event of non-compliance with the legislation of the country where the service is ordered. It is your responsibility to check with the local authorities the purchase of the services you intend to order.

Furthermore, Just_Elo cannot be held responsible for any damage resulting from misuse of the service ordered.

Finally, the company Just_Elo cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.

Article 11 - Rights applicable in the event of litigation

These terms and conditions of sale are governed by French law. The present general terms and conditions of sale in French are executed and interpreted in accordance with French law. In the event of a dispute, you must first contact the company Just_Elo for an amicable solution at the following address: [email protected]In the absence of an amicable solution, the French courts shall have sole jurisdiction.

Article 12 - Intellectual Property

The images on the website https://justelowebsiteeng.carrd.co are and remain the exclusive intellectual property of the company Just_Elo. Users undertake not to make any personal use of this content unless it has been produced for them. Total or partial reproduction of this content is strictly forbidden. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, images of the site

All works created by the company Just_Elo are protected by copyright under the law (Articles L121-1 to L123-12). We retain intellectual property rights and/or copyrights on all works.

Any infringement of copyright concerning the works and designs of the company Just_Elo will be prosecuted. It is strictly forbidden to claim intellectual property of the work or any copyright over it.

Article 13 - Right of Use

We reserve the right to publish your commission on the

With no maximum delay, you may request that your commission remain private and not be published or removed from these social media and this site at any time.No illustration previously commissioned will be used as a brand image, profile image or banner on the company's social-media. Nor will the illustrations be used to create physical products, or to resell or distribute them in any way whatsoever.We will not claim ownership of the subjects or characters depicted. Characters will be credited in the name(s) of the original owner(s).Files will not be intentionally shared in full resolution and/or unsigned in a way that allows their download and use. We will not provide these files to anyone other than the customer if requested.
Customers are free to use commissioned works for personal use, including:
- use as profile images and banners on social networks,
- personal printing of the work in small quantities,
- display or publication of the commissioned work on the customer's social networks, galleries or websites.Commercial use of commissioned works is not permitted without prior agreement. Commercial use includes:
- use of the work for branding and advertising;
- printing of the work as physical copies or as merchandise for sale.In the case of the resale of a design previously created by me, it is imperative that you speak to me beforehand, without any charged for the resale.All works commissioned for personal or commercial use must be credited in a visible way, with the artist's name “Just_Elo”.

The unauthorized use and appropriation of works created by Just_Elo is totally prohibited. Therefore, tracing, copying, stealing and using my works as avatars, profile pictures or banners on social networks without prior consent is not allowed.

Article 14 - Service

Our services include personalized illustrations, and the creation and sale of original characters. These services mainly concern animals, humanoid characters and anthropomorphic animals.However, we will be obliged to refuse your order if it includes one or more items from this (non-exhaustive) list:
- illustrations intended to incite hatred towards a community or entity.
- illustrations featuring detailed elements such as cars or characters with robotic armor.
- illustrations depicting acts and scenes with themes that are illegal under French law.
- illustrations featuring gore or extreme violence.

Article 15 - Lexicon

This article defines the specific terms of art in the field in which I work.- Headshot: equivalent to a portrait, stops at the figure's shoulders.- Halfbody: body visible up to halfway, stops at the character's hips.- Fullbody: full body, stops at the character's feet.- NSFW: Not Safe For Work, depicts nudity, violence and/or gore.- Symmetrical face: symmetrical illustration of the character's face, no neck or shoulders.- Custom: a character created from 0 to suit a specific description, moodboard or universe provided by the customer.- Moodboard: set of images representing a specific theme or universe.- Refsheet: drawing board representing a character's design from several angles, with accessories and color palette, providing a clearer, simpler vision of the design.
